Orders

  1. Any on-line purchase of products from Beyond One Bar On-Line Dive Store will be governed by these terms to the exclusion of any other terms.

  2. All products are offered subject to their availability.

  3. All orders are subject to acceptance by Beyond One Bar On-Line Dive Store.

  4. The quantity, quality and description of any specifications for the products shall be those set out in the site but you should be aware that the images appearing on the website are not always accurate. We reserve the right to correct errors and omissions in any price or other information without any liability. We are happy to offer advice Any advice or recommendations concerning the suitability or otherwise of a product for the intended user but point out that such advice is followed or acted upon entirely at your own risk.

  5. You should hold a recognised diving qualification issued by a recognised training organisation before purchasing or using any diving equipment from Beyond One Bar On-Line Dive Store.

  6. Please note items sold on clearance are non-returnable due to the nature of the sale

  7. Discount codes cannot be redeemed against special offers, clearance or sale items, newly released products, the purchasing of gift cards or used in conjunction with any other offers. Please read the terms and conditions of the individual discount code for any further exclusions. This does not apply when redeeming gift cards.

  8. We may contact you if we cannot accept your order due to a pricing or product description error on the website.

Delivery

  1. Items may sometimes be out of stock in our own warehouse, or that of the distributor or manufacturer. If this causes your order to be sent in more than one shipment, we will charge for the initial shipment only.

  2. You will be advised of the estimated delivery period but please leave up to 30 days for delivery. Items held in stock will usually be dispatched on the day following receipt of your order but some out-of-stock products may take longer. Any delivery date will be an estimate only. We shall not be liable for delays caused by matters outside our control.

  3. Any claim based on any defect in quality or condition of the products must be notified to us within 10 days of delivery after which you will be deemed to have accepted the products.

  4. The standard delivery cost per shipment to a mainland UK address is from 6.50. If you would like your goods shipped by another method or to a different country then you will need to contact us. There are some destinations that we are not able to ship to.

  5. Cylinders are delivered next day to UK mainland destinations by Parcelforce. A charge of 6.50 per cylinder will be added to your invoice. This is in addition to any other item which you may be ordering at the same time, as cylinders are transported in their own original box.

  6. Risk of damage to or loss of the product shall pass to you at the point at which it is delivered.

  7. All orders have to be sent to the card holders address.

  8. For all International orders we can only ship to the billing address. PO Box addresses will not be accepted.

Payment

  1. Payment is due on order. Payment will normally be debited from your card on the day the order is dispatched.

  2. It should be noted that your payment card will be debited in pounds sterling. You may use MasterCard, Visa, AMEX, Switch or you may mail to us a money order or personal cheque drawn on UK funds.

  3. All prices on the Beyond One Bar On-Line Dive Store website are subject to change without prior notice to reflect any increase in the cost to us.

  4. We aim to protect legitimate credit card owners from fraud and therefore will report to the necessary authorities any person attempting to use a card which they are not authorised to use.

  5. We hold the right to ask for a bank transfer for any order placed with us.

  6. In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

Property

  1. Property in the product shall pass to you provided your payment has cleared.

  2. Beyond One Bar On-Line Dive Store asserts all of its intellectual property rights in all of its promotional materials and trademarks.

Warranties and Liability

  1. To the extent permitted by law, we have no liability for the content of any websites which we may link to from this site or which may link to this site.

  2. All products supplied conform to all relevant British and European standards.

  3. All products are supplied with a full UK supplier's guarantee, the details of which are available on request.

  4. Should there be a defect in any of the product supplied then we will replace the defective products free of charge or if you choose not to have a replacement you are entitled to a full refund of the price of the product (or a proportionate part of the price). Your statutory rights are unaffected.

Returning Unwanted, Wrong size or Faulty Goods

Under the Consumer Rights Act you have an early right to reject goods that are unsatisfactory quality, unfit for purpose or not as described, and get a full refund.

But this right is limited to 30 days from the date you took ownership of the goods (this could be the date of purchase or the date the goods were delivered to you - whichever is later).

After the initial 30 days, you can't demand a full refund in the first instance, but you still have the right to a repair or replacement

  1. Damaged Goods: Please contact Beyond One Bar On-Line Dive Store immediately upon noticing any fault. The goods can then either be replaced F.O.C. or a full refund given. Please note that fault during use, such as flooding, may require goods to be returned to the manufacturer for warranty confirmation.

  2. Unwanted goods: Please contact Beyond One Bar On-Line Dive Store before returning any items. A refund (minus the cost of posting the item to you) can be issued for any unused returned goods. A restocking fee of 10% may be charged for all goods returned.

  3. Exchange goods: Please contact Beyond One Bar On-Line Dive Store before returning any items. If the item was ordered incorrectly i.e. wrong size or colour then a free exchange can be made. Postage will not be free on the returned item.

  4. General: When returning goods please enclose receipt, contact details (including daytime phone), credit card details and a note of why the goods are being returned.

Export

  1. If goods are to be shipped or used overseas, then it is your responsibility to ensure that the product is allowed to be shipped, and used in your country.

  2. We do not offer a refund (excluding faulty items) to countries outside the European Union.

  3. Incorrectly sized items (suits and BCDs, this excludes cylinders) dispatched outside the United Kingdom and inside the European Union can be exchanged but customers are responsible for the cost of shipping the items back to us together with the return carriage costs, to return the goods back to the customer.

  4. Consignments dispatched to addresses outside of the UK may only be sent to the registered billing address as held by your credit card company.

  5. Due to it being a circumstance beyond our control, we do not accept any responsibility for shipment delays due to customs issues and/or for any excise duties levied on a consignment.

Your right to cancel

You may cancel your order and return the products to us and receive a refund at any time up to seven days after you have received the products. To cancel or return all or part of an order you must notify us by completing our Returns Section Form requesting that the order be cancelled. Unless the item/s were specifically ordered in - this would then be looked at on an individual basis, and a refund or replacement would be at our discretion

We confirm that we will not pass on any of your information to any other company. The information we have about you will be stored on our computer and your details added to our mailing list.

General

You are not entitled to assign or transfer any of your rights or obligations under this contract. This contract shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.

DIVING COURSES AND DIVE TRIPS – TERMS AND CONDITIONS

All courses require a completed PADI Diving Medical Statement which can be downloaded below. The participant must answer all the questions with ‘Yes’ or ‘No’. If any questions require a “Yes” answer then a signature from a physician on the back of the form is required to confirm the participant is fit to dive. If this is not done prior to attending the course we are unable to allow the participant to dive and cancellation fees will be incurred.

To book the course we require full payment in advance unless an alternative payment scheme is agreed in advance in writing. Once booked your courses is non-refundable. If more than two weeks notice is supplied we will be happy to change the course to an alternative date but this is subject to availability. If you are prevented from attending due to a long term illness then we will refund the full cost of the course less a £25 administration charge providing you provide a valid and relevant doctor’s letter. Only the person(s) who is/are unfit to dive is entitled to receive a refund, if you will be fit to dive again within 6 months then we will reschedule your course to a date where you are fit enough to dive. Failure to arrive within 15 minutes of the start of your course will result in the cancellation of your course.

For UK dive trips a deposit will secure your space and final payment is required 4 weeks prior to departure. Overseas holidays will be subject to the terms and conditions of the suppliers we use.

1.         The contract between us

We must receive payment of the whole of the price for the services that you order before your order can be accepted. Payment of the price for the services represents an offer on your part to purchase the services, which will be accepted by us only when a confirmation of acceptance is sent by us.  Only at this point is a legally binding contract created between us.

2.         Acknowledgement of your order

To enable us to process your order, you will need to provide us with your e-mail address. We will notify you by e-mail as soon as possible to confirm receipt of your order and to confirm details. For the avoidance of doubt, this correspondence does not constitute a contract between us.

3.         Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Beyond One Bar. Any use  of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

4.         Accuracy of content

We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all services have been described accurately.

5.         Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

6.         Availability

The services will be provided within an agreed timescale, and time is not of the essence of the contract.

7.       Ordering errors

You are able to correct errors on your order up to the point on which you click on “submit” during the ordering process.

8.         Price

The prices payable for services that you order are as set out on our website. All prices are inclusive of VAT at the current rates and are correct at the time of entering information.

9.         Payment terms

We will take payment upon receipt of your order from your credit or debit card. We accept no liability if our services are delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the services from you, then we can refuse to process your order and/or suspend any further services. This does not affect any other rights we may have.

10.      Cancellation rights

10.1    Once booked your course is non-refundable unless for medical reasons stated in the summary at the beginning of this article.

10.2    In accordance with The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 SI 2013/3134 you cannot cancel your contract if the services you have ordered are passenger transport services, services (other than the supply of water, gas, electricity or heating) for which the price is dependent on fluctuations in the financial market, urgent repairs or maintenance where you have specifically requested a visit, accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities  (if the contract provides for a specific date or period of performance).

10.3    Should you wish to cancel your diving course or trip you must notify us in writing by any durable medium (for example letter sent by post or e-mail).

10.5    If you require us to begin the services within the Cancellation Period we require you to make an express request to do so.  In such cases, your right to cancel continues until either the end of the Cancellation Period, or the completion of the services, whichever is the earlier.  If you cancel during the Cancellation Period we may charge you for any services provided up until the point when we receive your cancellation notice, and will provide a partial and proportionate refund accordingly.  Your right to cancel the services will no longer apply once the services have been fully performed.

11.      Cancellation by us

11.1    We reserve the right not to process your order if:

11.1.1 We have insufficient staff or resources to deliver the services you have ordered;

11.1.2 We do not provide services to your area; or

11.1.3 One or more of the services you ordered was listed at an incorrect price due to a typographical error.

11.2    If we do not process your order for the above reasons, we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit/debit card as soon as possible, but in any event within 14 days.

12.      Liability

12.1    We are only responsible for losses that are a natural, foreseeable consequence of our breach of these terms and conditions.  We do not accept liability if we are prevented or delayed from complying with our obligations set out in these terms and conditions by anything you (or anyone acting with your express or implied authority) does or fails to do, or is due to events which are beyond our reasonable control.

12.2    Furthermore, we do not accept liability for any losses related to any business of yours including but not limited to: lost data, lost profits, lost revenues or business interruption.

12.3    Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.  

13.      Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Beyond One Bar, 22a Sizewell Road, Leiston, Suffolk IP16 4AB and all notices from us to you will be displayed on our website from time to time.

14.      Changes to legal notices

We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

15.      Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

16.      Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

17.      Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

18.      Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
